Müebbet hapsi istenen Mahmut Alınak, Kars 2. Ağır Ceza Mahkemesi’nde davanın ilk duruşmasında hakim karşısına çıktı. Müebbet hapsi istenen Alınak’ın yaşı ve tutuklu bulunduğu süreyi göz önüne alınarak Mahmut Alınak’ın tahliyesine karar verdi.
17 Şubat’ta tutuklanan Alınak son tutuklanmasıyla 10. kez cezaevine girdi. Alınak’a “Devletin topraklarının tamamını veya bir kısmını yabancı bir devletin egemenliği altına koymak, devletin birliğini bozmak, devletin egemenliği altında bulunan topraklardan bir kısmını devlet idaresinden ayırmak, devletin bağımsızlığını zayıflatmak” suçları isnat edilmişti.
